On Monday, the Biden administration began implementing its vaccine-or-test mandate for large-company employees. Due to the Supreme Court’s uncertainty on the pending challenges to the rule, some state leaders have taken matters into their own hands.

It took the Supreme Court nearly four hours to hear arguments on Friday over the two vaccine requirements of the Biden administration, cases that will have ramifications for tens of millions of workers, and the president’s contentious strategy to combat the virus.

In the case of vaccine requirements for private companies with more than 100 employees, the justices seemed pessimistic about the requirements but preferred a mandate for health care workers.

As part of preparing for the Supreme Court’s decision, other leaders are taking measures to protect the vaccine rule for private companies. A federal vaccine or test standard was adopted on Friday by the Illinois Department of Labor. In late December, New York City started mandating vaccinations for private-sector workers through its own ordinance. This mandate goes further than the one proposed by the Biden administration.

OSHA announced Monday that while the vaccine-or-test requirements began on Monday, only the first part of the rule is in effect – a masking requirement for workers without a vaccine – while the testing requirement will not come into effect until Feb 9. Employers should exercise good faith efforts to comply with the standard, so long as they are exercising reasonable efforts.

Workers must be fully vaccinated or tested weekly for Covid at companies with more than 100 employees. A special session of the court was held on Friday to consider the mandate. As many as 80 million US workers could be affected by the nine justices’ decisions.

Opinions On Mandates By Senators

In a Friday statement, some conservative justices on the court publicly expressed support for the mandate, including liberal Sonia Sotomayor, who suggested not requiring vaccines, but rather requiring people who are not vaccinated to mask and be tested. Although Kavanaugh and Gorsuch are conservative-leaning justices, they questioned whether OSHA was authorized to implement the mandate without congressional instruction.

OSHA’s vaccine mandate critics argued in court on Friday that the federal government overstepped its authority when it imposed the mandatory vaccine requirement, which covers about two-thirds of private-sector employees across the country.

In addition, lawyers for the coalition claimed that the vaccine would be costly for businesses, especially those who refuse to take the test.

Additionally, they have pointed out that if workers didn’t comply they would quit – an argument the government has contested. In an effort to prevent Covid-19’s spread and protect employees, the federal government wants the mandate to be in place by June so that over 250k hospitalizations and 6,000 deaths can be prevented. According to the government, the officials will try to enforce the mandate from 12th January 2022.
