Does the MCU need another Sokovia deal?
The Sokovia Accords were a set of legal documents in the MCU that allowed over a hundred countries to decide when, where, and how the Avengers could intervene in a conflict. It was basically to regulate their actions and hold them accountable for their actions. This piece of paper had devastating consequences for the Avengers during Civil war and separated them into two factions in the MCU. However, despite its flaws, the idea of the Sokovia Accords had some merit. His biggest mistake was the forced way he was applied and how he didn’t involve superheroes in his training. But there is no other way to prevent collateral damage and other devastating consequences. So here’s everything that went wrong with the Sokovia Accords and how they need to be improved and implemented.
Why is such a document required?
As we have seen, superheroes can often make rash decisions and, in turn, put the whole world in danger. It’s been a recurring theme in WandaVision, Spider-Man: No Way Home, and Multiverse of Madness in the MCU. So it’s pretty clear that superheroes need some sort of oversight and accountability. Since most human laws cannot fully apply to them, it makes more sense and efficiency to hold them accountable in a different way. This would essentially allow the justice system to be adapted to their needs. Instead of being a private military organization, they would be open to government surveillance. Moreover, it would even provide the Avengers with additional help and better facilitate them and their actions.
Such a document would also prevent disastrous political ramifications as seen in the MCU at the start of the Civil War when they sued Crossbones in Nigeria. Since the Avengers are primarily considered an American organization, their actions in other countries while ignoring national borders can often trigger unrest in the world and strain relations between the United States and other countries.
Finally, the most important point is that the world and ordinary people deserve answers. Since ordinary citizens often fall victim to battles between superheroes and villains, they should have some control over such situations. This would calm the public and give them a little more confidence.
How can the Sokovia Accords be improved?
The Sokovia Accords got a lot of things wrong. They excluded superheroes from the conversation, which was probably the biggest mistake. The Sokovia Accords focused too much on limiting them instead of allowing them to be better structured. His bossy nature is exactly what alarmed Steve Rogers in the MCU. The purpose of such a document is not to control superheroes but rather to help them reduce collateral damage, to empower them and to help them in their missions.
The Sokovia Accords instead treated the heroes a little too much like criminals, expecting to hunt them down and even detain them indefinitely without trial in some cases. Also, due to the wording of the Accords, they would only have applied to very few Avengers. Such a document must also contain clauses regarding emergency situations as in Infinity Wars. As in such a situation, the clearance and approval time is not exactly feasible.
Moreover, the Sokovia Accords have unbalanced outcomes for different individuals. For example, in the MCU, Sharon Carter became an enemy of the state and never had a proper trial or opportunity to vindicate and redeem herself. Such a document must have certain rules regarding the privacy of even enhanced individuals. It also requires laws specifically tailored to superheroes to prevent unlawful arrests and imprisonments. Superheroes should be part of the conversation and should also be able to edit the document. Unless these changes are implemented, the Sokovia Accords will never succeed in real life.
